Dan Heffernan provides his clients with over thirty years of experience in construction and insurance coverage law and commercial litigation, including construction defect and condominium law. In addition to his law degree with honors from Seattle University, Dan holds a bachelor of science degree in mechanical engineering from the University of Washington, a degree which uniquely qualifies him to represent clients in construction-related matters.

Dan represents owners, developers, contractors, and design professionals in construction and property development in both the public and private sectors. Dan advises his clients on contract and related issues and disputes, and handles complex commercial litigation on their behalf.

Dan has successfully resolved scores of multi-million dollar cases involving construction and insurance coverage. He has handled numerous major cases in state and federal trial courts, courts of appeal, and federal agency courts of appeal.

Dan is involved in community service coaching special needs athletes in swimming and basketball, and also coaching youth soccer. He has also served on the boards of several non-profits supporting persons with developmental disabilities.

  • Successfully defended window manufacturers against claims totaling over $100 million involving numerous high-rise condominium and apartment projects.

  • Represented contractor on claims against product supplier and OCIP insurer regarding claims for defects on high-rise condominium building. Recovered $6 million for client. 

  • Represented owner of high-rise apartment project on claims against supplier of defective construction products. Recovered $17 million for client. 

  • Represented owner of two large commercial warehouses on claims against general contractor, property manager and property insurer for defective heating/venting design and operations, and resulting damage. Recovered $6.8 million for client.

  • Represented owner of luxury apartment complex on claims for defective windows, resulting damage, and income loss.  Recovered over $5 million for client.

  • Represented owner of large commercial warehouse complex on claims against general contractor, architect, and property insurer. Recovered over $3 million for client.

  • Represented owner of high-rise mixed use project on claims against general contractor and architect for construction and design defects. Recovered over $50 million for client.

  • Represented owner of high-rise mixed-use project in claims against general contractor and architect for construction defects and building damage. Recovered more than $1.5 million for client.

  • Represented residential condominium association against developer for construction defects. Recovered $500,000 for client.

  • Successfully defended developer against multi-million dollar claims by residential condominium association for construction defects involving high-rise condominium tower.

  • Represented residential condominium association in claims against architects and contractors. Recovered $1.4 million for client.

  • Represented owner of several commercial buildings against property insurer for earthquake damage and business income loss. Recovered more than $2.6 million for client.

  • Successfully defended owner of large multi-use apartment project from over $6 million in claims by contractors for construction cost overruns and delays.

  • Represented equity partner in claims arising out of construction of high-rise residential project. Recovered more than $2.5 million for client.

  • Successfully defended developer of high-rise luxury condominium project against $13 million claim by general contractor for construction changes, delays, and impacts.

  • Represented municipality in claim against dredging contractor for damage to sewage treatment facility. Recovered $1 million for client.

  • Represented utility contractor in claims against surety arising out of public works project. Recovered $2.5 million for client.

  • Represented municipality in claims against its design professional. Recovered $225,000 for client.

  • Represented developer in claims against architect for design errors involving Americans with Disabilities Act compliance issues in construction of high-rise condominium. Recovered $300,000 for client.

  • Successfully defended developer against $1 million claim by town home condominium association.

  • Represented directional drilling contractor on public works project in claims for differing site conditions, delay, and impact. Recovered $350,000 for client.
